General Terms and Conditions of MC Tours Spain
1. Scope of Application
These General Terms and Conditions (GTC) apply to all contracts between MC Tours Spain, a company registered in Spain under the company number B-12345678, with its registered office at Calle Mayor, 123, 45678 Madrid, Spain (hereinafter referred to as "MC Tours Spain") and its customers for the provision of motorcycle tours in Spain.
2. Conclusion of the Contract
The contract for a motorcycle tour with MC Tours Spain is concluded by the customer's booking of the tour via the MC Tours Spain website or by telephone. The booking is considered to be accepted by MC Tours Spain upon receipt of a confirmation email or telephone call from MC Tours Spain.
3. Prices
The prices for motorcycle tours are stated on the MC Tours Spain website or are provided by MC Tours Spain upon request. The prices are inclusive of all taxes and fees.
4. Payment
The customer is obliged to pay the full tour price within 7 days of receiving the confirmation email or telephone call from MC Tours Spain. The payment can be made by credit card, debit card, or bank transfer.
5. Cancellation by the Customer
The customer may cancel the contract for a motorcycle tour at any time. If the cancellation is made more than 30 days before the start of the tour, the customer is entitled to a full refund of the tour price. If the cancellation is made less than 30 days before the start of the tour, the customer is entitled to a refund of 50% of the tour price. If the cancellation is made less than 14 days before the start of the tour, the customer is not entitled to a refund.
6. Cancellation by MC Tours Spain
MC Tours Spain may cancel the contract for a motorcycle tour if the minimum number of participants is not reached. In this case, MC Tours Spain will inform the customer as soon as possible and offer the customer a refund or a transfer to another tour.
7. Liability
MC Tours Spain is liable for any damage caused by MC Tours Spain or its employees or agents during the motorcycle tour. However, MC Tours Spain is not liable for any damage caused by force majeure or by the actions of the customer or third parties.
8. Governing Law
The contract between MC Tours Spain and the customer is governed by Spanish law.
9. Severability Clause
If any provision of these GTC is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
10. Entire Agreement
These GTC constitute the entire agreement between MC Tours Spain and the customer and supersede any prior or contemporaneous communications, representations, or agreements, whether oral or written.
Additional Terms and Conditions
11. Equipment
The customer is responsible for providing their own motorcycle and motorcycle equipment for the motorcycle tour. MC Tours Spain may provide motorcycle equipment for rent, but the customer is responsible for paying the rental costs.
12. Accommodation
Accommodation is not included in the price of the motorcycle tour. The customer is responsible for booking their own accommodation. MC Tours Spain may provide recommendations for accommodation.
13. Itinerary
The itinerary for the motorcycle tour is subject to change at the discretion of MC Tours Spain.
14. Medical Insurance
The customer is responsible for obtaining medical insurance for the motorcycle tour. MC Tours Spain recommends that the customer obtain travel insurance that covers medical expenses, repatriation, and cancellation.
15. Visas
The customer is responsible for obtaining any necessary visas for the motorcycle tour.
16. Language
The motorcycle tour will be conducted in Spanish. If the customer does not speak Spanish, MC Tours Spain may provide an English-speaking guide for an additional fee.
17. Dispute Resolution
Any disputes arising out of or in connection with the contract between MC Tours Spain and the customer shall be resolved by the courts of Madrid, Spain.
